利用規約

第 1 条（適用）

本規約は、開発者（以下「開発者」）が提供する iOS / watchOS アプリ「VoiceNote」（以下「本アプリ」）の利用条件を定めるものです。ユーザは本アプリを利用することにより、本規約、プライバシーポリシーおよび特定商取引法に基づく表記の内容に同意したものとみなします。

第 2 条（利用環境）

ユーザは自己の責任と費用で、本アプリの利用に必要な端末、OS、通信環境、Apple ID その他の利用環境を準備するものとします。録音機能を利用するため、マイク権限を本アプリに付与する必要があります。文字起こし・翻訳機能の一部はネットワーク接続を必要とする場合があります。

第 3 条（本アプリの機能）

本アプリは、音声の録音・文字起こし・翻訳・議事録生成を一貫して提供するボイスレコーダー兼議事録アプリです。主な機能は以下のとおりです。

文字起こしおよび議事録生成の処理は、原則として端末内で実行します。翻訳機能は、端末内モデルが利用可能な言語については端末内で処理し、利用できない場合は Apple のサーバーを経由する場合があります。

第 4 条（録音の取り扱い）

  1. ユーザは、録音の開始、停止、保存、削除その他一切の操作を自己の責任で行うものとします。
  2. 開発者は、録音の完全性・継続性・ファイルの保全を保証しません。端末の状態、ストレージ残量、OS の挙動、通信状態その他の理由により録音が失敗、消失または破損した場合でも、一切の責任を負いません。
  3. 録音を行う際は、関係する全員の同意を得るなど、適用される法令を遵守するものとします。

第 5 条（文字起こし・翻訳の取り扱い）

  1. 文字起こしおよび翻訳の結果は参考情報であり、開発者はその正確性・完全性を保証しません。
  2. 文字起こし処理は Apple Speech Framework を使用して端末内で実行されます。
  3. 翻訳機能は Apple Translation Framework を使用します。端末内の言語モデルが利用できない場合、テキストが Apple のサーバーに送信されることがあります。詳細はプライバシーポリシーを参照してください。
  4. 文字起こし・翻訳の結果はユーザが編集可能であり、開発者は内容の正確性について一切の責任を負いません。

第 6 条（議事録・要約生成）

  1. 議事録・要約生成は Apple Foundation Models を使用して端末内で実行されます。
  2. 生成された議事録・要約は AI による参考情報であり、内容の正確性・完全性を保証しません。ユーザは必ず内容を確認・編集のうえ使用するものとします。
  3. 生成結果には推測による決定事項が含まれる場合があります。生成内容をそのまま公式文書として使用することはせず、ユーザ自身の責任で確認・修正を行うものとします。
  4. 端末が Foundation Models に対応していない場合、または言語が対応していない場合は、機能が制限されることがあります。

第 7 条（watchOS companion アプリ）

watchOS companion アプリは、iPhone 側の録音操作と録音一覧の表示を補助するためのアプリです。文字起こし・翻訳・議事録生成の処理は iPhone が担当し、watchOS companion アプリは独立したこれらの機能を持ちません。watchOS companion アプリの機能は iPhone / Apple Watch 間の接続状態に依存します。

第 8 条（サブスクリプション）

  1. 開発者は本アプリにおいて、月額・年額の自動更新サブスクリプション（以下「本サブスク」）を提供する場合があります。
  2. 本サブスクは Apple StoreKit / App Store を通じて提供され、決済、更新、解約、返金その他の取扱いは Apple の規約およびポリシーに従います。
  3. サブスクリプション加入中は利用制限が解除され、文字起こし・翻訳・議事録生成機能を制限なく利用できます。
  4. 解約は iOS の「設定 → Apple ID → サブスクリプション」から行えます。次回更新日の 24 時間前までに解約しない場合、自動更新されることがあります。
  5. 価格、期間、無料お試し、提供条件は App Store 上の表示を優先します。

第 9 条（ログの取得）

開発者は、本アプリの品質向上、不具合調査、利用状況の把握および機能改善のため、個人情報を含まないログを取得する場合があります。ログの内容および取扱いは、プライバシーポリシーに定めるものとします。

第 10 条（禁止事項）

ユーザは以下の行為を行ってはなりません。

第 11 条（知的財産権）

本アプリ、関連ドキュメント、画像、文章、プログラムその他本アプリに関する知的財産権は、開発者または正当な権利者に帰属します。

第 12 条（保証の否認）

開発者は、本アプリについて、録音の完全性・文字起こしの正確性・翻訳の正確性・議事録生成の正確性・継続的な提供・特定目的への適合性・不具合や障害が発生しないこと・データが保持されること・第三者サービスが正常に動作することを含め、明示または黙示を問わず一切保証しません。

第 13 条（免責）

  1. 開発者は、本アプリの利用または利用不能、録音の失敗・消失・破損、文字起こし・翻訳・議事録生成の誤り・欠落、課金、第三者サービス、端末や OS の不具合、通信障害、その他本アプリに関連してユーザまたは第三者に生じた損害について、法令上許容される最大限の範囲で一切の責任を負いません。
  2. 前項にかかわらず、強行法規により開発者の責任を完全に免除できない場合であっても、開発者の責任は、開発者に故意または重過失がある場合を除き、ユーザが直近 1 か月に本アプリへ実際に支払った金額を上限とします。

第 14 条（サービスの変更・停止・終了）

開発者は、事前の通知なく、本アプリの全部または一部を変更、追加、停止、終了することができます。これによりユーザに損害が生じた場合でも、開発者は一切の責任を負いません。

第 15 条（規約の変更）

開発者は、必要に応じて本規約を改定できます。改定後の規約は、本アプリ内、App Store 上または開発者が適切と判断する方法で表示された時点から効力を生じます。ユーザが改定後に本アプリを利用した場合、改定後の規約に同意したものとみなします。

第 16 条（準拠法・管轄）

本規約は日本法を準拠法とします。本アプリに関して紛争が生じた場合、開発者の住所地を管轄する地方裁判所または簡易裁判所を第一審の専属的合意管轄裁判所とします。

Article 1 (Application)

These Terms of Use define the conditions for using the iOS / watchOS app "VoiceNote" (the "App") provided by the developer (the "Developer"). By using the App, users are deemed to have agreed to these Terms of Use, the Privacy Policy, and the notation based on Japan's Act on Specified Commercial Transactions.

Article 2 (Usage Environment)

Users are responsible, at their own cost, for preparing the device, OS, communication environment, Apple ID, and any other environment necessary to use the App. Microphone permission must be granted to the App to use recording features. Some transcription and translation features may require a network connection.

Article 3 (App Features)

The App is a voice recorder and meeting minutes application that provides integrated audio recording, transcription, translation, and meeting minutes generation. Main features include:

Transcription and meeting minutes generation are performed on the device as a general rule. For translation, languages supported by on-device models are processed locally; otherwise, the text may be sent to Apple's servers.

Article 4 (Handling of Recordings)

  1. Users are responsible for all operations, including starting, stopping, saving, and deleting recordings.
  2. The Developer does not guarantee recording completeness, continuity, or file preservation. The Developer assumes no responsibility for recording failures, loss, or corruption due to device state, available storage, OS behavior, network conditions, or any other reason.
  3. When making recordings, users must comply with applicable laws, including obtaining consent from all parties involved.

Article 5 (Handling of Transcription and Translation)

  1. Transcription and translation results are provided as reference information, and the Developer does not guarantee their accuracy or completeness.
  2. Transcription is performed on the device using Apple Speech Framework.
  3. Translation uses Apple Translation Framework. If an on-device language model is unavailable, text may be sent to Apple's servers. Refer to the Privacy Policy for details.
  4. Transcription and translation results are editable by the user, and the Developer assumes no responsibility for the accuracy of the content.

Article 6 (Meeting Minutes and Summary Generation)

  1. Meeting minutes and summary generation are performed on the device using Apple Foundation Models.
  2. Generated meeting minutes and summaries are AI-generated reference information, and the Developer does not guarantee their accuracy or completeness. Users must always review and edit the content before use.
  3. Generated content may include speculative conclusions. Users must not use generated content as-is in official documents and are responsible for reviewing and correcting it themselves.
  4. Features may be limited if the device does not support Foundation Models or the language is not supported.

Article 7 (watchOS Companion App)

The watchOS companion app is a supplementary app for controlling recording operations and viewing recording lists from the iPhone. Transcription, translation, and meeting minutes generation are handled by the iPhone; the watchOS companion app has no independent versions of these features. The watchOS companion app's functionality depends on the connection state between the iPhone and Apple Watch.

Article 8 (Subscriptions)

  1. The Developer may provide automatically renewing monthly or yearly subscriptions in the App (the "Subscription").
  2. The Subscription is provided through Apple StoreKit / App Store. Payment, renewal, cancellation, refunds, and other handling follow Apple's terms and policies.
  3. While a Subscription is active, usage limitations are removed and transcription, translation, and meeting minutes generation features can be used without restriction.
  4. Users can cancel from iOS "Settings > Apple ID > Subscriptions." If the user does not cancel at least 24 hours before the next renewal date, the Subscription may renew automatically.
  5. Prices, periods, free trials, and offer conditions shown on the App Store take precedence.

Article 9 (Log Collection)

The Developer may collect logs that do not include personal information for quality improvement, issue investigation, usage analysis, and feature improvement. The contents and handling of logs are defined in the Privacy Policy.

Article 10 (Prohibited Acts)

Users must not perform the following acts:

Article 11 (Intellectual Property Rights)

Intellectual property rights related to the App, related documents, images, text, programs, and other App-related materials belong to the Developer or legitimate rights holders.

Article 12 (Disclaimer of Warranty)

The Developer makes no express or implied warranty regarding the App, including recording completeness, transcription accuracy, translation accuracy, meeting minutes accuracy, continuous provision, fitness for a particular purpose, absence of defects or failures, data retention, or proper operation of third-party services.

Article 13 (Limitation of Liability)

  1. To the maximum extent permitted by law, the Developer assumes no responsibility for damages incurred by users or third parties in connection with use or inability to use the App, recording failures or data loss, transcription, translation, or meeting minutes errors or omissions, billing, third-party services, device or OS issues, communication failures, or any other App-related matter.
  2. If mandatory law does not permit complete exclusion of the Developer's liability, the Developer's liability is limited to the amount actually paid by the user to the App during the most recent one-month period, except in cases of intentional misconduct or gross negligence by the Developer.

Article 14 (Changes, Suspension, and Termination)

The Developer may change, add, suspend, or terminate all or part of the App without prior notice. The Developer assumes no responsibility for damages incurred by users as a result.

Article 15 (Changes to These Terms)

The Developer may revise these Terms of Use as necessary. The revised terms become effective when displayed in the App, on the App Store, or by another method the Developer considers appropriate. If users use the App after the revision, they are deemed to have agreed to the revised terms.

Article 16 (Governing Law and Jurisdiction)

These Terms of Use are governed by the laws of Japan. If a dispute arises in connection with the App, the district court or summary court having jurisdiction over the Developer's address shall be the exclusive court of first instance.
